A SENIOR police officer caught having sex with a stranger while on duty has walked free from court, after claiming he was still working as he had not switched his radio earpiece off.

British Transport Police Inspector Masood Khan, 41, was charged with misconduct in a public office after a 20-minute rendez-vous in a police office with a woman he had met on an Internet dating site called Uniform Dating.

The site promotes online dating for ''military singles, uniformed and emergency services or those seeking a date in uniform''.

After hearing all the evidence against Khan, a Southwark Crown Court jury found him not guilty, and dismissed his misconduct charge.

But Khan still faces an internal disciplinary hearing, where he could be sacked.

A British Transport Police spokesman would not comment on Khan's disciplinary hearing, but emphasised he must face disciplinary procedures after the jury acquitted him.

Khan met his woman, who cannot be named for legal reasons, through using an alias of ''Michael K Plod'' on the internet dating site.

He agreed to meet the woman at Gatwick Airport rail station on July 23 at 3pm, when he would have been on duty.

Khan first claimed he thought another inspector would have been on duty to relieve him from his job of leading 20 officers who were covering the rail network in the South East.

At his two-day trial, the court heard how he drove in full uniform to the rendezvous from his office in Victoria, central London, in a marked police car after telling a junior officer he needed the room for police business.

He arrived at the station in full uniform. CCTV footage showed the couple going into a sparsely furnished 'grubby' and 'unspectacular' office at the end of Platform Two and emerging 20 minutes later.

Khan, a police officer for 15 years, accepted the woman performed a sex act on him and they had full intercourse.

He admitted he discovered at midday that day that there would be no inspector to cover for him, but went ahead with the meeting anyway.

Despite this, Khan told jurors he was still working at the time he had sex.

In a police interview, he said their romp ""moved very quickly'' once they went inside the office.

''There was little chitchat. It was obvious she had been expecting to have sex,'' he said.

He was arrested two days later, but claimed he was always poised and ready to respond to an emergency because he had his earpiece on.

In the witness box at Southwark Crown Court, he said: ''If there was a call for me I would have answered it and dealt with it.''

After admitting to having sex, he also expressed regret for his actions, saying: 'It was an absolutely wrong thing to do, morally and professionally, and I shouldn't have done that.''

Khan's lawyer, Kevin Baumber, said his conduct amounted to ''misbehaviour'' but not ''criminal behaviour''.

He added: ''This is a criminal court, not a moral court. It's doubtful this case would have been brought if he'd taken an extended lunch break or gone for a game of golf.''
