damn thats gotta hurt, but no doubt it was her fault for "playing" in the fountains. dumb shit she did, but i agree she can sue if there was no hazard warning or safety constraints.

im honestly more inclined to blame the owners of this fountain then the girl. the chinese have a low regard for personal safety... something this powerful should be fenced off for sure
so every time someone do some stupid things, the first thing is to see if there's warning sign. otherwise, it's a cue for suing ... the gal is 19 y/o for god sake .. doesn't take a genius to figure it out that the water is high pressured and all .. the road is just as dangerous so should we put a fence up to to protect pedestrians .. this is common sense .. if some one is stupid, a fence or warn sign won't stop the action/behavior.
its not the same. Everyone knows the consequences of getting hit by a car even if you're not actively thinking about it, its so ingrained into most people's subconcious that you tend to do things like look both ways and keep alert when crossing the road. Something like getting blasted into the air by a water fountain is a bit more obscure. people think this girl was just stupid, but being stupid and acting stupid are different things. human beings act stupid all the time, and those who invest money into things like this should know that and have the forsight to anticipate situations like this. If this fountain wasn't fenced off and there were no warning signs around in regards to the potential danger of high pressure sprays then I think the girl is definitely justified in her lawsuit.

why do we have umbrella? to stay dry when it rains .. the same concept with the car and crossing the road ... you don't run into the fountain to get wet when you know it's not a swimming pool. people don't walk into a fountain knowing that they'll get wet .. this is common sense. yes, being stupid and acting stupid is somewhat different but doesn't mean they can't be the same for certain individual .. stupid people do stupid things.

^ i was referring to the idea that you said in the earlier post where crossing the street and looking both ways has ingrained in to our head at your young age .. the same with rain and umbrella .. my point was that it's common sense to stay away from the fountain and just enjoy the beauty of it. nothing more .. she obviously didn't do that .. she went playing in the fountain against any rational person would do. if you look at the pic, people were actually sitting away and enjoyed the fountain. In other words, she brought this upon herself. Like I said, it's a sad case but certainly do not find her incidence justifiable for large sum of money. She can only pull it off if there was indeed no sign but I am sure whoever designed the fountain know all the precaution as it's similar to the US. That may also be the reason why she didn't sue for more.

*leap frogging* we have this down town in toronto and lotsa people play around with it, i use it to wash my hands but i guess some people can be mistaken that it's all fun and games. If its made hard and unaccessible then the owners should not be to blame, now if you go out of your way to do something like that then it should be your own dumb fault.
