Not sure how a person could mistook a Chinese for a Indian man ,and there is an on going rise of racial attack against Indian students in Australia.

I can't believe this guy only gets 15 years in jail for killing a man.

    --

An Australian man was on Wednesday sentenced to 15 years in prison for killing a Chinese researcher after mistaking him for an Indian in a racially- motivated assault, sparking fears of a backlash from the Chinese community over the “inadequate” punishment.

The Victorian Supreme Court handed down the prison term to 21-year old John Caratozzolo from Melbourne, with Justice David Harper saying that racially-motivated attacks had no place in a multi-cultural society like Australia.

Before committing the crime, Caratozzolo had told his friends that he wanted to get a mobile phone from an Indian student, because they had better phones, Herald Sun reported.

Caratozzolo along with his six friends then attacked 41-year-old Chinese researcher Zhongjun Cao, who they took to be of Indian descent.

The court heard that Caratozzolo and his accomplices attacked Cao as he walked home from work at Victoria University, Footscray, in January last year. Cao fell to the ground before a laughing Caratozzolo kicked him in the head with enough force to damage his own foot.

After the fatal bashing, the group went on to attack another man, an Indian student, the report said.

Justice Harper said a second assault by Caratozzolo on another victim that night was also racist, adding Caratozzolo had learnt to swear at Indians in Hindi and had also memorised words and phrases “designed to cause maximum offence.” Caratozzolo will be eligible for parole in 10 years and has already served 549 days in custody.

The court heard the gang kicked the gentle Chinese researcher to death for fun while out “curry bashing” to get a new mobile phone.

    ... contd.

The judge said Caratozzolo’s attack was “intended to inflict as much gratuitous pain to increase pleasure” and his actions had increased everyone’s fear.

“Everyone in this city, state and this country -- visitors, students, residents, everyone -- whatever race or gender or beliefs, has the right to walk on its streets without fear,” he said. “This is a fundamental right that all of us are entitled to take for granted.” Meanwhile, the Victorian state government has been warned of a backlash from the Chinese community amidst protests by the Indian students against the increasing racial assaults on them.

“If (Victorian Premier) John Brumby thinks he has problems with the Indian community, wait until he sees the reaction of the Chinese community to this sentence,” Steve Medcraft, President of People Against Lenient Sentencing group, said reacting to the “inadequate” sentence given to Caratozzolo.

However, Medcraft was quoted by the media as saying that “these thugs went out to bash an Indian and when they couldn’t find one, they picked on a Chinese person instead.” “I find it amazing that someone with a record of extreme violence, which Caratozzolo had, could get such an inadequate sentence, even if he did plead guilty,” he said.

“It is time for the judiciary to be held accountable and for sentencing to reflect the horror and disgust of the community over crimes like this one,” Medcraft said.

Victims Support Group President Noel McNamara also called the sentence a “disgrace” which he believed would add to the pain of Cao’s widow and young daughter.

    ... contd.

Chinese community leader Wellington Lee said the courts were not reflecting public expectations.

“What is a life worth?” he asked and said “this is far too low a sentence for such a brutal act of thuggery and it sends the wrong message to the wider community. This was a defenceless man, an innocent victim. It has had devastating repercussions for his family."

Imagine if the victim had been of Jewish descent, what would the sentence have been? If people would just digest that comment for a second, they'll see that because most Asian, especially Chinese, often don't participate in the political process, there is no fear of us as a voting bloc. The difference here is, if you take Israel, which is arguably one of the most racist and self serving genocidal nations in the world; then see that it has the full and undying support of the US; one has to ask how is it that the Jewish people were able to engineer that (such political support) and why Chinese people can't do the same?

Most Chinese don't want to get involved, and that's already a huge political disadvantage. When you read a story like this, don't just get angry, get political. Make it a point to ask YOUR political leaders where they stand on anti-Chinese or anti-Asian hate crimes, EVEN IF IT HASN'T HAPPENED YET (in your neighborhood or country). It will put your politician on notice that Chinese people are watching them, AND that we'll hold them accountable.

Murder should be sentenced with life in prison or even the death penalty in my opinion...I wonder what argument was given by the judge for this low sentence.
I hope that the public prosecutor will appeal against this sentence...if not hopefully the family can get a good lawyer to fight a civil case...

Australian authorities always make weak statements to the press such as "such an attack has no place in this multi-cultural society". Who the *beep* cares about that, people hear this, but they don't really listen. Do something drastic about it, since these are the people who are granted the authority to deal judgement and justice, more should definitely be done about shit like this.
