I had my iphone 3G already over a year , and i brough it outright from a friend. We are using the same network carrier( At&t), it was Okay until now they charge me an extra $40 for the data plan ( I'm sure that i am not using any internet,data). I called them, and they basically said that " Our policy ( or say i don't care) if you using any smart phone, you will get charge for the data plan" So pissed right now, what should I do.... Of course, i can cancel the data plan if i am using a different phone...but fk that...
$40 for data? I thought it was $15 for 200mb and $25 for 2gb on ATT. there is no way of avoiding data charge when AT&T is in a search to change people's plan that don't have data on iPhone or other smartphones. They will automatically add a plan for you which there's only 2 option now for data 200mb and 2gb. You can't really do much.
Isn't that Violate our right ? For Force user to the Plan for a device that is not in contract with them. In another word, they are fking control what device we could use. Question: 1. At&t do sell Unlocked Iphone with a higher price , right? Are they Force user to with the data plan , too ? Noticed that the iphone is cost cheaper with if you contract with them for 2 years with the data plan. So what is the point for them to sell "unlocked iphone" with the higher price even they force you to bind that data plan anyway..
You violated their terms. Smartphones are required to have data plan on all providers now. 1. AT&T doesn't sell iPhone unlocked. It is still locked and branded by AT&T/Apple. So you still need data plan also. It's no commitment price, but you still have to have AT&T in order to purchase it at a high price.
Although its not that much better up here in Canada, at least I don't HAVE to have a data plan, just because I have a smartphone. They need to start making data plans cheaper to encourage usage, forcing people to have data isn't fair.
They are playing monopoly game i guess...Apple always stay stable on their price ( Computer, Accesserries, Iphone...etc) Apple + Iphone = ripped off.... Anyway, are there anyway to hack the device so they cannot detect it?
Not that I know of. Don't use an iPhone if you don't want to pay data. iPhone always been requiring data plan. Only some smartphone that you grandfathered before September of 2009 don't require data phone which excludes iPhone in general since all iPhone was required to have data plan since the First Generation from AT&T.

AT&T is slowly hunting people with Smartphone. They actually can see all phones but just not trying to identify all of it.

That was what i thought... I said to them that i bought it from a friend....and it was completely out of my pocket...And now they said I can't use it anymore, they gonna charge if continue using it... Isn't that b.s ? You bought something "unlocked" and they force you to join the data anyway... If i know so, I wouldn't pay extra more for the unlocked phone....
Just to let you know, US iPhone has never been unlocked. Unlocked iPhone is usually from users who jailbreak their iPhone. Otherwise it is locked to AT&T. iPhone in US is exclusive to AT&T only. Lately, people with "unlocked" Nexus One, bought straightly from Google, AT&T has detected a lot of the Nexus One and putting them on the "correct" plan. If you're using AT&T, it is in their terms and conditions. T-Mobile, how ever, if it's an unlocked phone you bought separately yourself, they won't charge you data YET. ALL SMARTPHONES IN US REQUIRE DATA NOW.
@lovetvb .. I don't know how you bought your phone ... did your friend cancel his plan with ATT already and gave you the phone in which you signed up for an acct with ATT again under your name?? This is the important part .. I don't know where you reside now .. in the US or not .. and I am not sure if ATT has a new policy in place that required all smartphone to sign up for a data plan. I don't have one on my own because all of my phones are paid by my company so I don't really know and it's with Verizon. The CONTRACT you signed doesn't change. If it's not part of the contract and you don't use the internet, then you shouldn't pay for it. It's optional. You should ask to speak with a manager when you call ATT and if thing don't get resolved, contact or go to your nearest PUC (Public Utilities Commission) and file a complaint against ATT. Again, as long as YOUR contract doesn't stipulate the requirements of owning a smart phone; you don't need to sign up. $40 is a lot of money for data plan + phone + taxes = $$$$ If I were you, I won't settle for it. Don't pay as well .. if you do so, then it meant that you accepted the terms. @ Runtohell .. the only time you need to sign up for a data plan is when you purchase a phone through a website or ATT store where you signed up for a contract for x years and get the phone at a bargain or FREE. Once your contract is over, you're freed to do whatever .. cancel certain thing like TEXT msg, data plan, etc... That requirement doesn't apply to non-contracted customer.

Even if the contract is OVER, you are still required to have a data plan on a smartphone as of September of 2009. iPhone, exclusively for AT&T, they have basically all the IMEI for iPhones. It doesn't matter if you bought it used or new from Apple since it is locked to AT&T only. There is no such thing as an "unlocked" iPhone in the United States. Any phone you buy that counts as a smartphone requires data plan. reporting to PUC or not, they can't do anything about it. AT&T has it's own term and condition that you signed to agree with. Using an iPhone, even if you bought it used from a friend or something doesn't mean you can get away without having a data plan. The only phones that can get away without a data plans are unlocked/unbranded excluding Nexus One where as many Nexus One owners are being caught using it with a "dumb phone" data plan or no data at all. Any smartphone, whether you're using data or not are required to have data. This applies to basically all the carriers as of now. Sprint, Verizon, AT&T, and T-Mobile are all the same. T-mobile however don't care YET.
It really sounds strange over there. I know that the US / Canada contracts are really stupid but that tops everything. If your friend canceled/finished the contract you normally can ask your provider to give you an unlock code since you PAID for the phone in FULL already. After that you can do with your phone whatever you want, since the iPhone is exclusive to AT&T in the US you prob. won't find another provider with a suitable dataplan. But honestly why having an iPhone without dataplan? It's more like an iPod then.
You can ask for unlock code for any phone from AT&T except iPhone. iPhone has no unlock codes for AT&T.
If thats the case I would boycott AT&T. Since I have paid for the item, I should be allowed to use it as I want. For instance I go abroad with the phone (after contract), I wont have any chance to use it.
That's the way it is for iPhone in the US with AT&T. No unlock code whether your contract is over or not. Most customers can request an unlock code after 3 or 9 months of their contract with the exception of the iPhone(s).
Normally for a new iphone, you will need to activate it at Apple or At&t, otherwise you couldn't use it. In my case, I already skipped that step...and I just need to put my Sim card in and use it ( I'm using At&t service, not sure if it gonna work with other carrier) . Before I pick up this Iphone, I already in contract with At&t ( exclude data plan). In the past year, everything was fine, they did not charge any for the data plan. About recently, they simply sent me a bill and saying that I have to pay the data if I continue to use the iphone. I said...hey it is my phone, how can you charge me for something I use and force me to the plan that I am not contracting with...But they simply said it's their policy.. Honestly, I use iphone and I'm sure that I won't ever use data for anything, so my initial thought was to buy an "unlocked" ones. Otherwise, I wouldn't stupid enough to pay extra IF i know it's gonna required data plan...I am finding ANY document regarding this requirement...
It is their policy. No matter what, even if you didn't go through the process of activation, iPhone are required to have data plan. I just don't see where the "$40" data plan coming from. I only know they have $15 for 200mb, $25 for 2gb, or $30 for unlimited if it's grandfathered.
