Even if an iphone is jailbreaked, the iphone is still detectable by AT&T via the IMEI. When they detect it, they will change your current plan and add on the data plan. The only thing that you can do is to stop using the iPhone or subscribe to a different provider like TMobile, where they don't charge you for data if you used the jailbreaked iPhone.

btw jailbreak and unlock is different. if iphone is jailbroken, it allows u to install apps and stuff for free. unlocked means that u can use any sim on the iphone.

^^disabling it or not, no difference. IMEI is what counts.

I don't see the reason for having a data plan either if a smartphone has wifi ... but anyway, I wouldn't know since I never had a need for a smartphone outside of the business world.

    From http://www.wireless.att.com/cell-phone-service/legal/plan-terms.jsp :

"Data Plans: An eligible data plan is required for certain devices, including iPhones and other designated smartphones. Eligible data plans cover data usage in the U.S. and do not cover international data usage and charges. If it is determined that you are using an iPhone or other designated smartphone without an eligible data plan, AT&T reserves the right to add an eligible data plan to your account and bill you the appropriate monthly fee."

Like I repeat above, it's the IMEI that they used to detect what phone you are using!!!
