    I've seen this video before, and this guy is indeed an idiot. The officers do not have to respond to any of his "legal" assertions insofar as they're performing their government assigned functions, and this is the street, not a courtroom. Further, his "legal" knowledge is so full of holes as to be laughable (eg. his use of the term "naturalization" is way off the true legal definition). Whilst he may think that he is right, his method of challenge to the officers is confrontation and thus, is easily within the parameters define by Interfering with a Public Official in the Performance of their Duties. They should have arrested his ass.

    Note:
    this is a distinction that many don't seem to fully understand; in the US, while the public is free to take videos while in the public space; if you get close enough, challenge, distract, or obstruct the officers while filming, then you just committed an offense that they can arrest you for.

    Hehe that was funny, whether he be right or wrong, the officers were clearly mentally defeated, I think they didn't answer him because they couldn't.

    One thing i do agree with is the whole 'American' thing, many (maybe not all) Americans will call a black, African American, Asian, Asian American etc etc but they call themselves 'American' and not 'European American', the only Americans I can think of are hauled on reservation sites or running tacky casinos.


    ^ well he's not a lawyer but for a 'layman' i think he is going in the right direction, he will learn more in time. I'm not sure if this is a 'lets hate on the black dude' video but I give him credit, his child was being questioned by the cops and he kept cool and was totally verbal. I think in the end the male cop wanted the guy to hit him so he could arrest him.

    If he got arrested I could see him representing himself lol

    I think you're right that the officers (including the supervising sergeant) was mentally flummoxed by what he was saying. She should never have started debating with him.

    The correct response would have been "Sir, you need to step back and allow us to carry out the court's order, or you will be subject to arrest." Then after several more of that above line (usually three is considered a more than reasonable number) it's, "Sir, I've already warned you three times to step back and allow us to carry out the court's order, I'm giving you a final warning that if you don't step back immediately, you will be placed under arrest." Then one more peep out of him and, "Sir, I'm placing you under arrest for interfering with a public official in the performance of their duty, turn around and place your hands behind your back"

    Notice that last part; it was not a request. It is the order of a police officer with the full legal authority as a law enforcement representative of their municipal government. If loud mouth then fails to comply then the officers can use levels of escalating physical force to take him into custody. As for his legal acumen; the man obviously has read up on a variety of legal principles and doctrines, and knows a smattering of historic terms. What is clearly evident from the video though is his absolute ignorance of their real meanings and how it applies to US jurisprudence and American law enforcement. In a public forum, he would undoubtedly be classed as a troll. He knows just enough to get himself into serious trouble if he were to rely on his witless understanding of law and use it to push the legal boundaries.

    My final opinion is that the officers (despite their composure) should use this as a training example of what NOT to do when confronted by loudmouths, and the idiot was decidedly a very lucky man to have avoided arrest.

    its not about the guy being right or wrong. It's just that he intimidated 5 police officers who should be the ones knowing the law. All you have to do is defend yourself and convince the police to think you know what you are talking about and they cannot do anything about it. The question is more why are the police officers letting this guy talk them down in law and they are the one with more authority. These police officers need to go back to law class and know how to handle this situation properly.

    As a father, he just wanted to protect his son who appears to be of african american decent and in the states, I'm pretty sure cops tend to detain them and do random checks on them more than other races.
