    It really depends on the situation, this won't be consider misused cause this idiot thought she was in danger. The police won't waste anymore time dealing with it.

    I think you hit this "selection" point rather nicely. While stupidity isn't illegal, it does in fact, effectively act to cull the herd, so to speak. Your surmise is correct in that people of her ilk and manner, would likely die off very quickly in any crisis situation.
