Dude was on house arrest.... the courts threw the case out because the "evidence" was forcefully gathered without a warrant and therefore can not be used in a court of law, is what I understand.
Depends on where. My friend got a DUI, and he was able to be in a location with internet access due to work. Of course he had to pay a major fee though
