What do you do?

    This is just a hypothetical situation .. how or what would you do?

    A guy found out his wife cheated on him, baby isn't his, dropped out of school to work, and sold everything (home, car, etc) to settle the divorce.

    go back to school, do what he always had wanted to do

    Court ordered him to pay alimony and child support (even when the child isn't his) .. life is a mess for the guy.

    either way, not much you can do, maybe a prenuptial is best nowadays
     
  7. whoa whoa whoa.... why does this guy have to pay child support for a kid that isn't even his? that is ridiculous... bitch committed adultery.... that is messed up. I don't even know how I would handle this but probably try to get off the hook of having to pay child support. eff that BS

    well its a bit late for prenup for that guy
    but given the kid isn't his, i don' see how the court can rule it in that way
    i'm sure there's many law firms that would fight for him (and only take cuts if they win)
    could sue retrospectively for the whole time they were together being "mislead" etc etc

    well if the birthcertificate has his name on it he has some responsibility for the child even though its not his... If his name is not on the birthcertificate then the court would have not ordered child support. His lawyer should have done the DNA test with the child to prove that the child is not the father and nor is his responsibility to pay child support. He can appeal to divorce court judge for that. I hope this information helps... This is california law though i do not know about other states.

    NO this is not me and I hope it will never occur to me.

    Yeah, his name is on the birth certificate and he has been taking care of the child since birth until now .. 5 years old. The judge ordered him to pay cuz his name is on the cert. The judge asked him .. why would he love the child any less now he found the kid ain't his unless he never loved the kid at all? The kid is innocent and all ... blah, blah, blah.

    all i can say is divorce court judge will always give the bitter end of the stick to the guy. They never ever give any simpathy to the guy at all...

    Depend on your state. I think your friend need a better lawyer.

    Isnt alimony paid by the partner with the higher income? If the woman works, isnt possible for your mate to become a bum (with some bullshit reason that he had a nerve breakdown, migraine and stress ), and recieve alimony from the woman. Keep it a couple months and just remarry to end the alimony. And start working again.

    I think if the guy want to divorce his wife.. So by law he have to pay child support.

    But in his case because the child have no blood-relate to the father. That why the father dont want to pay chiild support.

    i'm not a guy but if i were him,i would get a great lawyer and i would never let that woman get divorce easily.oh boy,some women r disgusting.i hate cheaters wether they r boys or girls.
